Australia is one of the most popular countries in the world for migration. Every year, the state issues more than 200,000 permanent residence permits and almost 7 million temporary visas. Representatives of various countries of the world go to the country: New Zealand, Great Britain, Fiji, Lithuania, Nepal, Cameroon, etc. The country has developed numerous migration programs and different types of visas, which usually depend on the purpose of the expat, among them the visa for elderly parents, also known as the 804 permit.

The 804 visa is a special type of Australian visa that allows a certain category of elderly people to live permanently in Australia. To get this visa, you must already be in Australia and meet the retirement age requirements at the time of application.


Who is eligible for an Australian Parent Visa?


To obtain an 804 visa to Australia, the applicant must meet the following requirements:

- Having a sponsor in Australia - in most cases, your child will be the sponsor, who must be over 18 years old.

- Pass a family balance test, including confirming that you have more children living in Australia than in any other country.

- Reach the retirement age according to the rules of Australia (over 67 years).

- Be of good character (you do not have a serious criminal record, in particular you have not been convicted of domestic violence or a breach of immigration law, you have not been accused of sexual violence and generally the Australian Security Service does not consider you to be a threat).

- The sponsor must provide the applicant with a guarantee of support – this means you must prove that you will not be dependent on the Australian Government for financial support.

- You must not have had your Australian visa refused or cancelled.

- Do not have an 870 Parent Sponsored Visa. You must wait for it to expire before you can apply for an 804 visa.

- You must not have a valid 870 visa application.


The list of documents for obtaining Parental visa 804 in Australia


To apply for an 804 visa, prepare the following package of documents:

- The passport on the basis of which you entered Australia.

- Birth certificate - it is necessary to indicate the names of both your parents.

- Birth certificates of all family members included in the application. If someone cannot provide a birth certificate: a family registration document, an identification document (ID) issued by a government agency, a court-issued document proving your identity.

- Four recent photos of each applicant (on a white background, size 45x35 mm).

- Form 40 Sponsorship to migrate to Australia completed by your sponsor.

- Completed application form for parental visa (form 47PA).

- Birth certificates of all your children, even those who do not live in Australia.

- Certificate of adoption, for adopted children.

- If one of the applicants is or was married: marriage certificate.

- If one of the applicants is divorced: divorce papers.

- If one of the applicants is widowed: death certificate.

- If any of the applicants has changed their last name: name change documents.

- If one of the applicants has completed military service: confirmation of completion of military service.

- If the sponsor is not your child: confirmation of your relationship.

- Confirmation of the payment of the first installment of the visa fee.

Residence requirements for an Australian 804 visa


In order to apply for an Australian 804 parent visa, you must already be in Australia. You can enter the country on a regular tourist visa, and once you've applied, you'll be granted an interim visa that will allow you to stay in Australia until your application is resolved.


Procedure for applying for an 804 visa in Australia


1. Your sponsor fills out the sponsorship form (40), which you need to add to the rest of the documents.

2. Collect the necessary documents according to the checklist above.

3. Come to Australia if you haven't already.

4. Pay the first installment of the visa fee.

5. Apply to the Parent Visa Center (PVC) of the Department of the Interior.

6. Wait for the visa to be issued. Please note that PVC may ask you to provide any additional documents or information during application processing.

7. If you meet the requirements, your application will be queued for final processing.

8. Wait your turn, it can last more than 20 years.

9. After passing all stages, get a visa.


Can other family members apply with the main applicant?


You can apply for an 804 visa together with your immediate family members, which include:

- Husband or partner.

- Dependent children under the age of 18. This also includes any partners you have and adopted children.

- Children aged 18 to 23 who are dependent on you or your spouse.

- Children over the age of 18 who are dependent on you or your spouse due to disability.

Your children must not be married or in a cohabiting relationship to be eligible to apply with you.


How long does the 804 visa process take?


Australia has a limit on the number of 804 visas that can be issued in a year. Therefore, you can wait up to 30 years for your permit to be issued.

There are categories of Aged Parent Visa that are issued faster (subclasses 884 and 864), but the processing fee here is significantly higher.


How much does it cost to apply for an 804 visa to Australia?


The fee for the 804 Aged Parent Visa is AUD$6,415 and is payable in two installments: an initial fee of AUD$4,425 (US$3,050) and a second fee of AUD$2,000 (US$1,380) once your application has been sent for final processing ).

Each family member applying with you will be charged an additional visa fee.


Is it possible to work on the basis of the 804 Aged Parent Visa?


Once you are granted an 804 visa, you will be allowed to work in Australia. You can also complete a training course if you wish and even sponsor any other family member to come to Australia in the future.


Can 804 visa holders travel outside Australia?


Once you have obtained an Australian subclass 804 visa, you can leave and return to Australia without any restrictions, but only for up to five years.


Can I get a pension in Australia on an 804 visa?


Yes, you can apply for the Age Pension in Australia if you have an 804 visa, but only after you have been a resident for at least ten years.
