The White House has resumed the deportation of Russian citizens. Find out more about why the government made this decision and what the consequences are
According to the Guardian newspaper, the leadership of the United States, without an official announcement, resumed the procedure of deportation of Russians who escaped from mobilization. At the beginning of the full-scale Russian invasion of Ukraine, the state administration decided to suspend deportations to Russia, Ukraine and seven other countries: Belarus, Georgia, Hungary, Moldova, Poland, Slovakia and Romania. However, the other day, a lawyer from Texas, Jennifer Scarborough, told the publication that one of her clients was deported to Russia. According to the human rights activist, the US immigration authorities decided that the threat of being sent to the front is not a reason for granting asylum.
The lawyer explained that the Russian came to the US through the border with Mexico and requested political asylum due to the fear of being subject to partial mobilization. Instead, the migration service officials recognized that fear for their safety due to refusal of military service was not a sufficient reason for obtaining asylum. Jennifer Scarborough works with several more clients from Russia who have fled the mobilization, and now they also fear that they may be deported. In Russia, they can face prison or being sent to the front line.
At the same time, one of the human rights defender's clients managed to file a complaint in time and was given the opportunity to conduct a second interview, during which immigration officers established that the fear of being drafted was a well-founded application for asylum. Although obtaining a substantiated fear finding is only the first step in a potentially successful asylum application, it is one of the most important.
Importantly! After receiving a refusal, you need to file a complaint in time, the foreigner has 7 days to do so.
The US leadership has not yet commented on this information. According to U.S. Immigration and Customs Enforcement (Ice), they operate humanely, efficiently and professionally in compliance with immigration laws. That is, the procedure of deportation to all countries, including Russia, is carried out in accordance with the established rules.
