Citizenship by birth and origin

As a result of marriage
foreigner who came to live in Azerbaijan and entered into a marriage union with a citizen of the country may apply for citizenship. The legislation does not define the deadlines after which the right to apply for a marriage passport comes. In most cases, the application is approved after 5 years of residence of the spouses in an official marriage.
On naturalization
Foreigner can initiate this procedure after 5 years of continuous stay in the country
The application will be approved subject to a number of conditions

- the presence of an official confirmed monthly income
the presence of a permit for permanent residence
When is dual citizenship possible?
Officially, the government does not approve of having a second passport and, when issuing a permit for obtaining citizenship, requires renouncing the citizenship of another country.
But at the same time, a newly minted Azerbaijani can keep his passport, and with it his second citizenship. On the territory of Azerbaijan, he will obey only local laws.
Thus, an ambiguous situation develops:
- the authorities do not approve of second citizenship -
- officially no one interferes with the preservation of a second passport
Оbservance of the Constitution and laws of the Republic of Azerbaijan, who have submitted relevant documents on knowledge of the state language of the Republic of Azerbaijan, regardless of their race and nationality, gender, education, religious affiliation, political and other views, may be admitted to the citizenship of the Republic of Azerbaijan in accordance with the legislation of the Republic of Azerbaijan on based on your own request.
The period of permanent residence in the territory of the Republic of Azerbaijan of a foreign citizen or stateless person is calculated from the date of receipt of a permanent residence permit in accordance with the procedure established by law.
A person who was a citizen of the Republic of Azerbaijan in the past or whose citizenship of the Republic of Azerbaijan has been terminated may be restored to citizenship of the Republic of Azerbaijan at his own request, subject to the restrictions listed in the second part of Article 14 of the Law of the Republic of Azerbaijan “On Citizenship of the Republic of Azerbaijan”.
Withdrawal from the citizenship of the Azerbaijan Republic is carried out at the request of a person in the manner prescribed by law.
Persons residing in the territory of the Republic of Azerbaijan apply to the State Migration Service in connection with the restoration or termination of citizenship of the Republic of Azerbaijan, and persons residing in foreign states through diplomatic missions or consular offices to the Ministry of Foreign Affairs.
On the issue of obtaining citizenship of the Azerbaijan Republic, foreign citizens and stateless persons apply to the State Migration Service of the Azerbaijan Republic.
If a person, upon taking citizenship of the Azerbaijan Republic, deliberately falsified the information necessary for obtaining citizenship or presented a fake document, he is deprived of the citizenship of the Azerbaijan Republic acquired by him.
The President of the Republic of Azerbaijan issues an appropriate order on acceptance, restoration of citizenship of the Republic of Azerbaijan or termination of citizenship.
Acquisition of citizenship
A person wishing to acquire citizenship of the Republic of Azerbaijan applies to the State Migration Service of the Republic of Azerbaijan with a completed application form addressed to the President of the Republic of Azerbaijan, the sample of which is approved by the President of the Republic of Azerbaijan.
- Application form (must be typed on a computer) - printed in 2 copies;
- Application addressed to the President of the Republic of Azerbaijan (should be typed on a computer) - printed in 2 copies;
- CV (should be typed on a computer) - printed in 2 copies;
- Photo (size 3x4 cm) - 4 pieces;
- Check for payment of state duty (200 manats);
- Certificate from the Ministry of Education on knowledge of the state language of the Republic of Azerbaijan;
- A copy of a passport or other document for crossing the border (with the exception of persons who have received refugee status, who do not have these documents, as well as persons regarding whom the court has established the fact that they do not belong to the citizenship of any state, as well as permanent residence in the Republic of Azerbaijan) - (attach a notarial certified translation);
- A document confirming the existence of a legal source of income (one of the following documents: certificate of employment (c indication of wages), certificate of receipt of a pension, allowance or targeted state social assistance, certificate of the tax authority on the income of an individual, certificate of receipt of alimony, certificate of income of the person in whose care it is, certificate of the right to inheritance, etc.); If a person does not work, a citizen of the Republic of Azerbaijan can take on the obligation.
In this case:
- Statement of commitment of the person who assumes the obligation (certified by a notary public);
- Identity card of the person who undertakes the obligation (certified by a notary public );
- A document confirming the legal source of income of the person who undertakes the obligation (certificate from the place of work, about pensions, scholarships, etc.);
- A copy of the court decision on establishing the fact that the person has no citizenship of any state, as well as permanent residence in the Republic of Azerbaijan in accordance with part four of Article 14 of the Law of the Republic of Azerbaijan "On Citizenship of the Republic of Azerbaijan";
- For persons with high achievements in the field of science, technology, culture or sports, provided for in paragraph 1 of part 4 of article 14 of the Law of the Republic of Azerbaijan "On Citizenship of the Republic of Azerbaijan", a substantiated petition of the state body that invited him to the Republic of Azerbaijan.
- Copies of identity cards of close relatives who are citizens of the Republic of Azerbaijan. (If available).
When applying for citizenship of the Republic of Azerbaijan together with their minor children, the following documents must be attached:
- Statement of consent of the other parent (notarized);
- Copy of the passport of the other parent (notarized);
- Copy of marriage certificate;
- Statements of consent of children aged 14-18 (notarized).
Note: The application form and application must also contain the names of minor children of the applicant, as well as 4 photographs (size 3x4 cm).
Restoration of citizenship
A person wishing to restore citizenship of the Republic of Azerbaijan shall apply with an application form addressed to the President of the Republic of Azerbaijan.
- Application form (must be typed on a computer) - printed in 2 copies;
- Application addressed to the President of the Republic of Azerbaijan (should be typed on a computer) - printed in 2 copies;
- CV (should be typed on a computer) - printed in 2 copies;
- Photo (size 3x4cm) - 4 pieces;
- Check for payment of state duty (200 manats);
- Copy of an identity document (notarized);
- Certificate of HIV testing and general health status;
- Information about hepatitis B and C;
- Certificate from the TB dispensary;
- Certificate from the Dermatovenerologic Dispensary;
- Certificate from the Psychoneurological dispensary.
Note: Medical certificates are not required if the person applying for restoration of citizenship has not left the republic.
When submitting an application for restoration of citizenship of the Republic of Azerbaijan, along with their minor children, the following documents must be attached:
- Statement of consent of the other parent (notarized);
- Copy of the passport of the other parent (notarized);
- Copy of marriage certificate;
- Statements of consent of children aged 14-18 (notarized).
Note: The application form and application must also contain the names of minor children of the applicant, as well as 4 photographs (size 3x4 cm).
Withdrawal from citizenship
A citizen of the Republic of Azerbaijan shall apply with an application form for renunciation of the citizenship of the Republic of Azerbaijan addressed to the President of the Republic of Azerbaijan.
- Application form (must be typed on a computer) - printed in 2 copies;
- Application addressed to the President of the Republic of Azerbaijan (should be typed on a computer indicating the reason for renunciation of citizenship) - printed in 2 copies;
- Biography (should be typed on a computer) - printed in 2 copies;
- Photo (size 3x4 cm) - 4 pieces;
- Check for payment of state duty (200 manats);
- Copy of an identity document;
- A document from the Azerbaijan Credit Bureau confirming the absence of a loan obligation;
- Document from the State Tax Service of the Republic of Azerbaijan on the absence of tax liability to the state;
- A document from the Main Executive Department of the Ministry of Justice of the Republic of Azerbaijan on the absence of alimony payments in respect of a person and other executive documents;
- A document on the absence of military duty (a notarized copy of a military ID or a certificate from the local branch of the State Service for Mobilization and Conscription for Military Service, where the person is registered);
- Certificate from the housing maintenance site at the place of residence on the absence of debt for housing and communal services;
- Certificate of the relevant local department of Azersu CJSC on the absence of debts for water use and wastewater discharge;
- Certificate of no debt for the use of gas;
- Certificate of no debt for the use of electricity;
- Certificate of no debt on telephone conversations.
Note: certificates in connection with communication and communal services are not required from persons providing a document confirming the absence of real estate in their name.
When submitting an application for renunciation of the citizenship of the Republic of Azerbaijan, together with their minor children, the following documents must be attached:
- Statement of consent of the other parent (notarized) ;
- Copy of the passport of the other parent (notarized);
- Copy of marriage certificate;
- Statements of consent of children aged 14-18 (notarized).
- A copy of the certificate of primary military registration - applies to boys over 15 years old (notarized).
Note: The application form and application must also contain the names of minor children of the applicant, as well as 4 photographs (size 3x4 cm).
