- Illegal entry

Foreign nationals who enter India without valid travel documents, such as a passport or visa, can face imprisonment for up to five years and a fine of up to 5 lakh rupees (US$5,840).


- Use of forged documents

Foreign nationals entering India with a forged passport or visa will face imprisonment for up to seven years and a fine of up to INR 10 lakh (USD 11,629).

This measure is aimed at preventing fraud and strengthening the integrity of India's immigration system.


- Overstaying and visa violation

Foreign nationals who overstay their visa, violate visa conditions or enter prohibited areas can face imprisonment of up to three years, a fine of up to INR 3 lakh, or both.


Mandatory reporting by establishments and transporters in India


According to the new law, hotels, universities, educational institutions, hospitals, etc. will have to provide information about foreign nationals to the competent authorities. This measure is aimed at effectively monitoring and tracking overstaying foreigners in India.


- Obligations of carriers

International airlines and shipping companies are required to submit a list of passengers and crew along with advance notice to the Indian authorities at designated ports.

Failure to comply can result in fines of up to Rs 5 lakh (US$ 5,840) and non-payment can lead to arrest or impoundment of the vehicle.

The Immigration and Foreigners Bill, 2025 replaces four existing laws. It balances the interests of national security with the promotion of tourism and economic growth.

- Passport (Entry into India) Act, 1920.

- Foreigners Registration Act, 1939.
