The document provides for one of the most extensive updates to anti-tobacco legislation in the last fifteen years, and the ban on smoking on terraces in Spain will be its most visible part – if the bill goes all the way through parliament.

For now, this is a bill, not a valid law. The Council of Ministers led by Pedro Sánchez approved the text on July 21, after which it went to the General Cortes for consideration. The Spanish government is a minority, so the document could be significantly modified or even blocked by the opposition parties, which together control the majority of votes in Congress. Therefore, no official source has yet given a date when the new rules will actually come into effect.

- Terraces of bars, restaurants and other hospitality establishments;

- Sea and river beaches, as well as outdoor swimming pools;

- Sports grounds, stadiums and national parks;

- Company cars (except for purely personal use);

- Any public outdoor events - concerts, festivals, sporting events.

Separately, the bill introduces 15-meter “protection zones” around the entrances to hospitals, schools, universities, libraries, museums and playgrounds. Health Minister Monica Garcia explains the logic simply: a person who wants to calmly drink a coffee on a terrace should not inhale other people's smoke as a “free addition to the menu”.

Minors and nicotine sachets

One of the key innovations is a direct ban on tobacco consumption by persons under 18 years of age. Previously, Spanish law only prohibited the sale and supply of tobacco products to minors, but did not provide for penalties for the act of smoking. It is significant that the share of daily smokers among 14-18 year-olds is now at a historic low of 4.3%, while overall teenage tobacco use in the last month remains high (15.5%). E-cigarettes are equated with regular ones

Another significant change concerns vapes: the law treats them on a par with regular cigarettes in all areas where smoking will be prohibited. This applies to devices with and without nicotine, as well as hookahs and herbal smoking products. Only specialized outlets will be able to sell such products, which will be prohibited from placing any advertising visible from the outside. Interestingly, compared to the 2025 version of the bill, the government temporarily removed the ban on disposable vapes and plain cigarette packaging - both items promise to be returned later, when the relevant regulation at the EU level is tightened.

Advertising, fines and deadlines

The restrictions on tobacco advertising and sponsorship will apply to all media and platforms, including the internet. TV presenters and guests will be banned from appearing in the frame with a cigarette or vape, and tobacco brands will not be able to display their logos. As for sanctions, local media are reporting fines ranging from 200,000 to 600,000 euros, depending on the severity of the violation; for minors, the minimum fines start at 200 euros and can be replaced by community service.

If the law is passed, it will come into force 20 days after its publication in the Official State Gazette, and establishments will have two months to update their signs indicating the new smoke-free zones.
