Canada Tightens C20 Work Permit Rules in 2026: What Changed for Employers
Canada has introduced new C20 work permit requirements for foreign professionals. Find out exactly what has changed in the rules from July 2026, who will be affected by the new criteria, and what alternative work permits remain available to employers
Canada has made significant changes to the conditions for obtaining one of the most popular work permits exempt from the Labor Market Impact Assessment (LMIA). This is the C20 category, known as “Reciprocal Employment” – from July 29, 2026, the C20 work permit is available only to those foreign specialists who already have an active employment relationship with a company outside Canada. Previously, such a requirement did not actually exist, and this opened a loophole that international companies actively used.

What is a C20 work permit in Canada?
The C20 work permit is part of Canada’s International Mobility Program and allows foreign nationals to work in Canada without going through the LMIA procedure. The key condition is that the employment must create or support similar opportunities for Canadians or permanent residents abroad. Simply put: if an international company transfers an employee to a Canadian office, it must simultaneously open the way for Canadians to work in its foreign offices.
Previously, this category was interpreted quite broadly. Companies could issue work permits even to candidates who were actually supposed to start work only after arriving in Canada – that is, without any prior experience in a foreign company structure. This loophole has now been closed.

What has changed in the Canadian C20 visa rules in 2026?
Updated instructions from the Department of Immigration, Refugees and Citizenship Canada (IRCC) require that the applicant is already in an employment relationship with the same organization abroad at the time of submitting an application under the C20 category. A candidate who was hired only on the eve of the move or who was supposed to start work after arriving in Canada no longer falls under this category.
IRCC also clarified the very essence of reciprocal employment: it should actually create opportunities for Canadians and permanent residents to work abroad, and not be a formality on paper. Moreover, the new interpretation applies not only to new applications - immigration officers will assess compliance with the requirements at the time of decision, and not at the time of submission of documents. This means that even applications that are already under consideration may fall under the new, stricter criteria.
Separate clarifications also apply to applications for renewal of a permit and changes in employment conditions - here IRCC advises officers to check the candidate's employment history in more detail with the company.

Who are the changes to the C20 visa application process in Canada affecting?
The new rules primarily affect large international companies that regularly move staff between their offices around the world, as well as professionals who were considering moving to Canada through an internal transfer within their own company. While it was previously possible to agree on formal employment “on paper” immediately before the move, now the candidate’s employment history abroad is subject to a much more thorough check by Canadian immigration authorities.
For professionals who have been officially working in a foreign division of the company for some time and are planning an internal transfer to a Canadian office, the essence of the procedure does not change significantly. The problem arises precisely for those whose employment in an international structure was supposed to begin only at the time or on the eve of the move.

Alternative Work Permits for Employers in Canada
As the C20 category has narrowed, employers should consider other, more formalized ways to transfer staff to Canada.
The closest analogue is the Intra-Company Transfer (ICT) permit, which is issued under the codes C61, C62 or C63, depending on whether the person is a manager, senior manager or specialist with specialized knowledge. Unlike C20, ICT originally required that the candidate have worked for the company for at least one year within the last three years, so this category is less sensitive to the new requirements. The Canadian host organization must be a parent company, branch, subsidiary or affiliated organization of the foreign employer, and the company itself must conduct actual activities in at least two countries.
The second option is a standard LMIA-based work permit, when a Canadian employer confirms through a Labour Market Impact Assessment that there is no similar candidate for the vacancy among Canadian citizens and permanent residents. This path is longer and requires more documents, but it does not depend on the candidate's previous employment history abroad.
Companies that have previously actively used the C20 category to hire new employees directly for Canadian positions should check in advance whether the ICT or the standard LMIA procedure is suitable for them to avoid delays or refusals.

What does the abolition of C20 mean in practice?
The main conclusion for employers and specialists is simple: the presence of real, documented employment abroad is now a prerequisite, not a formality. Companies should prepare confirmation of the candidate's work experience in advance - employment contracts, salary certificates, personnel orders - even before submitting an application. Professionals who are only planning to move to Canada through an international employer should check whether their current situation meets the new criteria before starting the application process.
Overall, this change fits into a broader trend in recent years: Canada has gradually narrowed and clarified the categories of work permits exempt from the LMIA, rather than allowing for a broad interpretation.
The history of Canada’s immigration rules shows that work permit criteria can change quickly, and what worked a few months ago may no longer work today. If you are considering moving to Canada through an international employer – whether through an intra-corporate transfer or a standard LMIA-based procedure – it is important to know the full list of documents and the sequence of steps in advance so as not to waste time correcting your application.

Reminder! A high salary does not guarantee a high standard of living. In some countries, even high incomes are eaten up by expensive rent, food, and services, while in others, workers can afford much more thanks to strong purchasing power.
