There are less than two months left until the critical deadline. All EU residence documents in Poland issued before August 1, 2021 will automatically expire on August 3, 2026 – and this applies to those certificates whose validity period on paper is unlimited. There is critically little time left for renewal, and the consequences of inaction may be more serious than they seem.


Poland introduced new standards for residence documents for EU citizens back in August 2021 – in accordance with Directive 2004/38/EC and the Law of December 10, 2020. The new documents are valid for 10 years for EU citizens and up to five years for their family members from third countries. The old format received a transition period – but it is coming to an end.

Who are the new rules for residence permits in Poland?


All EU citizens registered in Poland are required to replace their certificates by August 3, 2026. This applies to documents issued before August 1, 2021: even those that do not contain an expiration date are formally considered valid only until this date and are subject to mandatory replacement with new samples in accordance with the Law of December 10, 2020.


Particular attention should be paid to those who have old yellow registration books in their hands - they are the ones that most often do not have a specified expiration date and their owners may not suspect that the document falls under the deadline. If your certificate was issued before August 2021 - regardless of the format - it needs to be replaced.


We remind you that registration in Poland is mandatory for EU citizens who plan to stay in the country for more than three months. The right to a registration certificate is granted to those who:


- officially work or conduct business in Poland;

- have sufficient financial resources for self-sufficiency;

- study;

- are married to a Polish citizen.

Separately – family members from third countries


Regarding family members who are not EU citizens, the situation is even more acute. For them, residence permits issued before August 2021 will expire on August 3, 2026 or on the expiration date indicated in the document, whichever comes first. Missing the deadline for this category of persons may result in a ban on re-entry to Poland and the Schengen area until a new document is obtained.

How to apply for a replacement for an old residence permit in Poland?


The replacement procedure consists of two stages. First, the application is submitted via the MOS (Moduł Obsługi Spraw) portal – from April 27, 2026 this is the only acceptable method of submission, paper applications are no longer considered. After verification of the application, you must personally visit the provincial immigration office to submit biometric data - fingerprints and a photo.


The authorities are obliged to accept the application submitted at any time until August 3, 2026 - however, the practice of individual offices may differ. For example, the Warsaw Immigration Office recommends submitting the application six to eight weeks before the deadline. Given this, a practical guideline is no later than July 4, 2026.


The list of required documents may vary slightly depending on the region: some voivodeships require the provision of fresh supporting documents regarding the purpose of residence - for example, a new letter from the employer or a current student status. The Polish authorities do not always publish the current requirements in advance, so it is worth contacting your office directly or a migration lawyer.

What happens if you miss the deadline?


If a person does not replace the document by August 3, 2026, they will lose their valid residence permit and will have to submit a new application with a full package of documents - as in the initial application. In addition, administrative liability in the form of a fine is provided.


For family members who are not EU citizens - the risks are even more serious: until they receive a new document, they may be refused entry to Poland and the entire Schengen area.
